Terms of Service

Effective date: 22 April 2026

1. Acceptance

By using the iTranslator Discord bot or website (“Service”) you agree to these Terms of Service. If you do not agree, do not use the Service. These Terms work together with the Terms of Sale and the Privacy Policy.

2. Eligibility

You must be at least 15 years old (French digital consent threshold) and meet Discord’s own minimum age requirement to use the Service. Where local law sets a higher age, the stricter rule applies. By using the Service you confirm you are eligible.

3. Access / Account

Access is through Discord OAuth; we do not create separate local accounts. You are responsible for securing your Discord account and any actions performed through it.

4. Licence

We grant you a limited, non‑exclusive, non‑transferable, revocable licence to use the Service for your own internal purposes. You may not resell, sublicense, copy, reverse engineer or attempt to extract source code.

5. User Content

You remain owner of the content you submit and of the outputs generated. You grant us a licence to process that content only to provide, secure and improve the Service (including anonymous caching).

You represent and warrant that you hold all necessary rights to submit the content and that it does not infringe any third‑party right, violate any law, or breach any applicable regulation. You are solely responsible for the content you submit and for any consequences of its processing through the Service.

6. Acceptable Use

  • Use the Service for lawful purposes only.
  • No bypassing, overloading or interfering with technical limits.
  • No unauthorised access, probing or building a competing product without written consent.

We may disable the Service for a user or guild in case of abuse or violation.

7. Support

Support is provided on a best‑effort basis by email at [email protected] and on our official Discord server at discord.itranslator.app. We may refuse support at our discretion.

8. Availability

The Service may be modified, suspended or discontinued at any time. Downtime may occur. No SLA is provided.

9. Third‑Party Services

The Service depends on Discord and external AI/LLM providers. Their failures or changes may impact the Service; we are not responsible for their acts or omissions.

10. Disclaimer

Translations, transcriptions and audio outputs are provided “as is” and may contain errors. You are solely responsible for any decisions or publications based on them.

11. Limitation of Liability

To the maximum extent permitted by law we are not liable for indirect or consequential loss (loss of profit, data, business). Our total aggregate liability arising from the Service will not exceed the amounts paid by you in the 12 months prior to the event. Nothing excludes liability that cannot be excluded by law (e.g. fraud, gross negligence, mandatory consumer rights).

12. Indemnification (Business Users)

This Section applies to business users only and does not apply to consumers. If you use the Service for professional or business purposes, you will indemnify and hold us harmless from claims, damages and costs (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of third‑party rights.

Consumers remain liable for their own acts and omissions under applicable French law (in particular article 1240 of the Civil Code), but no contractual indemnification obligation is imposed on them under this Section.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately for violation of these Terms, abuse, security risk or legal request. Sections intended to survive (e.g. licence restrictions, limitation of liability, indemnification) remain in effect.

14. Changes

We may update these Terms. The updated version is posted on the website with a new effective date. Continued use after publication constitutes acceptance.

15. Governing Law

French law governs these Terms. For business users, exclusive jurisdiction is with the courts of Lyon (France). Consumers may also bring proceedings before their local competent courts.
